The idea that Kirby took no risk is absurd and blatantly untrue. Kirby could have been fired and lost income. This could have lead to him not being hired again by another company.
Someone please enlighten us at where exactly Kirby could have published the FF, Avengers, Hulk, etc, as a creator-owned property? Are we so naive that we don't factor in the politics of keeping the little publishers down during this period? Come on.

Please keep it civil. I'm honestly not sure whether you are addressing Disney, one of the linked articles, or another poster in this thread, and that ambiguity can lead someone to believe you are calling them "naive". I agree with your points, though.

Sorry, I wasn't addressing anyone here personally. I was addressing the comments of the Disney lawyer and the overall tone of his comments.

I don't think Marc Toberoff is a particularly nice man either. There was a really good interview with a lawyer many years ago on cgs about toberoff and his own practises.

What kills me is the circular argument:
Business Man: "They signed the deal. It's legally binding."
Ethical person: "Yes, but is it fair to write up such a deal in the first place? Particularly when the game is rigged in your favor not only economically but politically as well?"
Business Man: "Nobody is forcing them to work in this business."
Ethical Person: "True, but that's besides the point."
I don't mind these corporations doing what they do as much as I mind their infuriating and absolute refusal to admit that they are, at their very core, unethical in holding fast to rules and regulations written up in Draconian times. "Of course we'd never treat creators like this NOW...but Kirby signed the deal! Suck it!"

No indication yet whether the settlement was strictly monetary, or if it involves some kind of copyright sharing or what. The outstanding "work-for-hire" questions will have to be settled in some other IP case, one without the more complicated issues of the "Marvel method."

Thank God this is finally settled. The Kirby's get some recognition for Jack and some money.
Disney looks like the good guys, buys some good PR, and finally puts it out of sight.
