No foul. This is a cover motif for many decades now. The fallen/lying down hero shooting up at the enemy or the reverse the enemy shooting down (these cases both show flying and running) at the hero.

The trope of characters fighting giant creatures close to swallowing them whole is very old, but I wanted to show how often this kind of cover found a home on superhero covers (and the expected fantasy covers, to boot). I left giant sharks out of the selection process, as too many covers increased in number after the release of Jaws (1975), and some were just poor cash-ins on the various A and B-sheets for that film.
