Except technically, Cap is not an original member-that's Iron Man, Hulk, Thor, Ant-Man, Wasp, but he does have founder status and Hulk doesn't, which is some how a retcon of a retcon of a retcon of whatever. That's what happens when you have 50+ years of stories by diverse hands and try to make a coherent whole out of them.

Captain America IS in the Avengers Charter as one of the founding members. He used that status to restructure the team In #211.

And which version of the charter, they have been a dozen to a score different versions over the years in various different writers takes on the Avengers structure-again each one a retcon of a retcon of a retcon.... -M |
